Parking and Vehicle Access Issues

There have been, and continue to be, incidences of vehicle parking on, and unauthorised vehicle access over, Corby Glen Village Green. Moreover, some residents have developed properties to have driveways installed without communicating to the Corby Glen Parish Council.

Corby Glen Parish Council sought advice from national government. It reads as follows:

The present view of the Department is that there is no means by which a vehicular right of way can be granted or acquired over a village green. Such a grant or acquisition would involve interference with the inhabitants’ rights or recreation and would involve breaches of Section 12 of the Inclosure Act 1857 and Section 29 of the Commons Act 1876.  The advice continues:

The only way you [Parish Council] may be able to overcome the difficulties […] in a manner fair to all, is if any of the prospective applicants [ residents wanting vehicular access] are to offer the same arear of non-village green land in exchange for the village green required for the access. They [residents wanting vehicular access] could then apply for an Order of Exchange under Section 147 of the Inclosure Act 1847, as the statutory protections over the village green would have been removed and transferred to exchange land.

There are some properties which have vehicle access over Corby Glen Village Green from before it was dedicated as village green. For all other properties, Corby Glen Parish Council asserts that they should NOT be marketed or transferred on basis that parking or vehicle access is available. Successfully attaining permission from Planning & Highways Authorities for garages, drives, accesses on private land and dropped kerbs joining the highways does not mean that vehicle access is granted.   

Access for utility companies may be governed by law. Should property owners or residents of the properties adjoining Corby Glen Village Green wish to dispute this information, they are requested to contact Corby Glen Parish Council Clerk in the first instance for discussion. Similarly for access for building works a discussion must be had with the Parish Council. 

Where unauthorised parking or vehicle access is observed, and damage caused, the Parish Council will communicate with those responsible for the property concerned in the hope of a civil and respectful resolution. Corby Glen Parish Council may seek legal help in individual cases.

Corby Glen Village Green cannot be fenced off by any party, even around play equipment.
